Mr. Penny represents senior living, long-term care and hospitality operators, lenders and investors in transactions involving finance, development, construction, acquisition, leasing and corporate ventures.
In his work at Smith/Packett Med-Com, LLC, based in Roanoke, Virginia, Mr. Penney led internal and external counsel on new facility construction transactions worth more than $200 million annually. He has provided business and legal advice on construction, debt and equity markets, finance, corporate structure and governance, and contract law. He also led acquisition and sale negotiations. Closure of managed commercial real estate. He has also advised on issues relating to zoning, land use, construction litigation and contract disputes. During this time, Mr. Penny also served as lead counsel for two of his affiliates. One of which he’s a senior living management company with over 40 locations and he has over 3,000 residents and the other he’s managing over $1 billion in assets. It was his private equity firm. He has extensively dealt with employment, licensing, care, insurance, and other related matters.

In his nearly 20 years of legal experience, Mr. Penny spent six years as a private attorney handling a variety of real estate and business matters.
