Liberal nurses: the order may file a complaint on their behalf

Liberal nurses: the order may file a complaint on their behalf

A decree makes fully operational the system allowing professional orders as well as regional unions of health professionals (URPS) to file complaints, on behalf of health professionals practicing in a liberal capacity, with their written consent.

According to the National Order of Nurses (ONI) “The publication of this decree is a continuation of the PRADAL law of July 9, 2025 aimed at strengthening the safety of healthcare professionals. It constitutes a major step forward to better protect nurses faced with violence in the exercise of their profession.”

“This development responds to a reality that we can no longer accept: no caregiver should give up asserting their rights after having suffered violence in the exercise of their profession,” stipulates the ONI. The consultation carried out by the Order in 2025 showed that 38% of nurses who were victims of sexist or sexual violence had not taken any action, most often for fear of reprisals, fear of not being heard or of having to take the steps alone.

This essential development will facilitate the procedures for victims and will help to remove obstacles to filing complaints. For several years, the Order has been working to prevent this violence, support professionals and develop the legal framework. This commitment is reflected in particular by:

  • The creation of a Caregiver Safety Observatory;
  • The establishment of “violence” referents in each Departmental Council, trained to support nurse victims;
  • The signing of an agreement with the Interministerial Mission for the Protection of Women (MIPROF);
  • A partnership with France Victimes, to strengthen support for professionals;
  • A dedicated platform, offering resources to prevent violence and guide nurses who are witnesses or victims of violence: http://stopviolences.ordre-entreprises.fr

Decree No. 2026-641 of July 20, 2026 establishing the terms of application of Article 5 of Law No. 2025-623 of July 9, 2025 aimed at strengthening the safety of healthcare professionals
