Prison overcrowding: “No national-scale measures have been taken”!

Prison overcrowding: “No national-scale measures have been taken”!

The General Controller of places of deprivation of liberty (CGLPL) publishes this Thursday, July 2, 2026, three texts in the Official Journal. The first is an opinion relating to prison overcrowding, the following two are emergency recommendations concerning the men’s remand center at the Fresnes penitentiary center (Val-de-Marne) and the Grenoble penitentiary center (Isère). Review of details.

Opinion of April 27, 2026 relating to prison overcrowding

Almost three years after the publication of its previous opinion on overpopulation and prison regulation (Official Journal of September 14, 2023), the CGLPL notes not only that no national-scale measures have been taken in this area, but also that the prison population has continued to grow to reach a level such that in several establishments, the multiple consequences of overpopulation seriously undermine the dignity and rights of detained persons. Prison and healthcare staff members, who are insufficient in number compared to the number of people to be cared for, continue to work in abnormally difficult conditions with no prospect of improvement. Many remand centers are also in a worrying state of dilapidation.

La moyenne du taux d’occupation des maisons d’arrêt était de 168,4 % au 1er mars 2026, alors qu’il approchait 145 % le 1er juin 2023 ;
- la moyenne du taux d’occupation des centres de détention au 1er mars 2026 était de 99,6 %, alors qu’elle approchait 95 % le 1er juin 2023 ;
- au 1er mars 2026, plus de 47 931 détenus (soit plus de la moitié des personnes incarcérées) étaient hébergés dans des établissements dont la densité d’occupation dépasse 150 %, contre 27 000 au 1er juin 2023 ;
- le nombre de matelas au sol était de 6 875 au 1er mars 2026, contre 2 336 au 1er juin 2023 soit une augmentation de 194 %.

In this new opinion, informed by the findings made over the last three years during its visits to establishments, the CGLPL reiterates its recommendation to include in law a binding prison regulation mechanismmanaged locally by all actors in the penal chain under the responsibility of the judicial authority, in order to allow, within a time limit set by law, to reduce overcrowding in remand centers, to respect the right to individual confinement and to put an end to the practice of housing people on mattresses on the ground.

- La surpopulation, toujours croissante, continue de dégrader gravement les conditions de vie des détenus et de travail du personnel.
- Le personnel pénitentiaire est en sous-effectif chronique sans qu’aucune mesure ne soit prise pour y remédier.
- La surpopulation ne permet pas de garantir un accès effectif au travail, à l’enseignement et aux activités socioculturelles.
- Les transferts en désencombrement portent atteinte à la vie privée et familiale des détenus.
- Le respect de l’intégrité physique et psychique n’est toujours pas assuré dans les établissements surpeuplés.
- Les établissements les plus surpeuplés font face à une augmentation des violences graves entre détenus et peinent à endiguer ce phénomène.
- Les tentatives de réduction de la population carcérale ont échoué, à l’exception de celle prise durant la crise sanitaire

Emergency recommendations relating to the men’s remand center of the Fresnes penitentiary center (Val-de-Marne)

Carried out from March 30 to April 10, 2026 by the General Controller and eight controllers, the 4e visit to the men’s remand center of the Fresnes penitentiary center led to the observation of serious violations of the rights of those detained. 10 years after the previous emergency recommendations made on this establishment, prison overcrowding is at its highest (171% occupancy), professionals are understaffed, prisoners are housed in unworthy conditions without a major renovation program, activities are insufficient, security measures implemented in the establishment are disproportionate and undermine the dignity of prisoners.

Combined with the extreme dilapidation and unsanitary conditions of the place, the chronic overoccupancy of the Fresnes men’s remand center seriously undermines the dignity of the prisoners and the working conditions of the staff. Professional practices must evolve in favor of respect for the dignity and integrity of detained persons. Without delay, the public authorities must define a clear real estate strategy for the future of the penitentiary center, including a renovation or reconstruction program commensurate with its observed deterioration.

- Les mesures de sécurité, disproportionnées et inefficaces, sont attentatoires à la dignité.

Emergency recommendations relating to the Grenoble prison center (Isère)

From March 30 to April 3, 2026, four controllers visited the Grenoble penitentiary center to follow up on the emergency recommendations made following the previous visit to the establishment, in July 2023.

Prison overcrowding, already noted and denounced in 2023, has worsened further (209% occupancy in the men’s remand center area). It leads to degrading conditions of incarceration, which undermine the dignity of people detained in undignified and unsanitary premises where pests proliferate. It also causes serious harm to the physical and psychological health of incarcerated people, with the establishment no longer having the means to ensure their safety. Violence between prisoners is a daily occurrence. The seriousness of the situation is such that it violates the prohibition of inhuman or degrading treatment. Prison officers, understaffed, continue to carry out their missions in abnormally difficult conditions, with no prospect of improvement.

Constats et attentes
- Les moyens humains sont insuffisants et incompatibles avec la protection des détenus.
- L’indignité est accrue par l’insalubrité. Les détenus vivent des conditions indignes dès leur arrivée.
- L’hygiène déplorable des locaux favorise la prolifération de nuisibles. Sans délai, les détenus doivent avoir accès à des douches salubres, afin de prévenir des atteintes graves à leur santé, à leur dignité et à leur intimité.
- Les perspectives d’amélioration des conditions de détention à court terme sont inexistantes. Les parloirs et les locaux de l’unité sanitaire de niveau 1 doivent être rénovés.
- La santé physique et psychique des détenus est gravement menacée. La sécurité alimentaire n’est pas garantie. Les violences entre détenus sont quotidiennes.
- Les personnes privées de liberté doivent être protégées de toute violence et leur sécurité doit être assurée partout et en tout temps. Les victimes de violence doivent
bénéficier d’un avis médical urgent, y compris en service de nuit. Les détenus vulnérables doivent bénéficier d’une prise en charge sanitaire adaptée.

The opinion relating to prison overcrowding and the emergency recommendations on the Fresnes penitentiary center were sent to the Ministers of Justice and Health so that they could inform the CGLPL of their observations. The emergency recommendations on the Grenoble penitentiary center were addressed to the Minister of Justice only. Responses are now awaited.
